Critics of the devolution of U.S. federal regulatory power to the states often worry about the danger that powerful interests could "capture" the regulatory process and the "race to the bottom" problem. Quantitatively examining the state-level regulation of ten sectors, Teske (public affairs, U. of Colorado) finds that capture is a problem, but not nearly as large as many fear. He similarly discounts fears about the "race to the bottom." The empirical studies explore the regulation of telecommunications, electricity, insurance solvency, savings and loan solvency, hospital certificates-of-need, attorneys, medical doctors, clean air plans, and groundwater protection.
