The cases and the notes in this book of lightly edited cases aim to demonstrate how the substance of a body of law like torts is heavily influenced by rules of procedure. Contemporary cases are used as much as possible, and some 'easy' cases are included. The book also contains opinions from intermediate appellate courts. It begins with a detailed overview offering introduction to torts. Part 2 covers liability for physical harms, and part 3 deals with battery, assault, false imprisonment, and infliction of emotional distress. Part 4 covers liability without fault and products liability, and part 5 looks at torts in the Supreme Court. An appendix offers about 45 pages of materials related to a case against Wal-Mart stores. A supporting website contains additional cases with notes. This third edition reflects current law, with updated material on federal preemption of state tort law, and new material on human rights litigation and the Alien Tort Statute.
